4. The outer horizontal surface shall be a horizontal plane extending outward from the outer and upper periphery of the conical surface, and shall be a projected plane with a radius of not more than 24,000 meters, as specified in Ordinances of the Ministry of Transport, from the aerodrome reference point (except the part where the projected plane corresponds with the projected plane of the horizontal surface and conical surface), and shall also be limited to that area necessary for securing the safety of take-off and landing of aircraft.

 

Article 56.-(3). The Minister of Transport shall, in the case of designation under the preceding Article paragraph 1 or for alterations to the items already designated, incorporate considerations so as not to severely impede the interests of the owners of land or other persons who have interests in the vicinity of the aerodrome.

 

2. The provisions of Article 38 paragraph 3, Article 39 paragraph 2 and Article 40 shall apply accordingly to designation under the preceding Article paragraph 1 or to alterations to items already designated.

 

Article 56-(4). No person shall install, place or leave any structures (except the constructing part referring to such works of the structures which are under construction at the time of notification), plants or any other objects which protrude above the extended approach surface, conical surface or outer horizontal surface (the surface taken shall be the lowest if overlap of these projected surfaces occur) described in the said notification, when notification is issued under Article 40 which applies accordingly to the preceding Article paragraph 2 with regard to aerodromes as specified b the provisions of Article 56-(2) paragraph 1.

 

2. The proviso of Article 49 paragraph 1 shall apply accordingly to the conical surface and the outer horizontal surface.

 

3. The provisions of Article 49 paragraph 2 shall apply accordingly to structures in violation of the provisions of paragraph 1, and the provisions of the said Article paragraph 3 through paragraph 8 shall apply accordingly to structures existing at the time of notification under paragraph 1 and which protrude above the extended approach surface, the conical surface or the outer horizontal surface.

 

(Designation of Facilities available for Public Use)
Article 56-(5). The Minister of Transport may, when he deems it necessary in enhancing the public interest, designate the landing area and any other facilities of the SelfDefence Forces' aerodrome as facilities open to public use.

 

2. The designation under the preceding paragraph shall be established by notifying the public of the name and location of the facilities concerned and the
